COMMISSION:

YOU WILL NEED THE FOLLOWING DOCUMENTATION:

  • The title deeds or a Nota Simple of the property.
  • Last receipt of Tax of Real estate (I.B.I.).
  • Letter of confirmation of Payment of Community Fees from the Community of Proprietors, although we recommend that this is requested until a few days before completion at the Notary´S office.
  • Certificate that there are no capital gains taxes on the property.
  • Certificate of energy efficiency
  • Copy of statutes that govern the Community of Proprietors. If property comes from an inheritance or a recent acquisition, to verify that the corresponding tax is eliminated.
  • Last receipt of the mortgage or the writing of the cancellation of the same.

TAXES:

Plusvalía Patrimoniales

If the seller is a foreign nonresident in Spain, the Law forces the buyer to retain 3% of the sale price, this retention will held by the Tributary Administration

Plusvalía Municipales

This is the municipal captal gains tax and is based on the castaral value of the ground and the length of time the owner has owned the property. The Local Council will make a calculation once the house has been sold, and this by mutual aggrement between buyer and seller can be negotiated between them on who pays what.
